Early Learning Victoria is a child-safe organisation. We have a zero-tolerance approach to child abuse and harm.
Our Staff code of conduct and Child safety code of conduct outline the behaviour expected from all Early Learning Victoria centre staff. The same standards apply to people connected with Early Learning Victoria centres.
These two codes reflect our strong commitment to child safety, our guiding philosophy, and our legal duties.
All children at Early Learning Victoria centres have the right to feel safe, happy and supported. Staff, volunteers and families all play an important role in this. Together, we create safe, welcoming and inclusive environments where children learn and thrive.
1. Scope
This code applies to families, staff, management and visitors of Early Learning Victoria centres. This includes volunteers, students on placement and contractors or labour-hire employees of Early Learning Victoria. Acknowledgement of the Code of Conduct is required.
2. Policy statement
This code outlines the behaviour expected from all staff working in Early Learning Victoria centres.
It sets out how staff should interact with each other, with children in their care, with families, and with people in the community.
Everyone at an Early Learning Victoria centre, including visitors and families, must be respectful towards others
2.1 Requirements
All staff must comply with or follow:
- the VPS Code of Conduct
- the Public Sector Values set out in the Public Administration Act 2004
- the Education and Care Services National Law Act 2010 (the National Law)
- the Education and Care Services National Regulations 2011 (the National Regulations)
- the National Quality Standards
- the Child Safe Standards (including maintaining a child-safe environment)
- professional codes of conduct (depending on their employment classification)
- the Protecting children policy
- the United Nations Convention on the Rights of the Child.
They must also understand the requirements of Early Childhood Australia’s Code of Ethics.
3. Actions and procedures
Respectful relationships are essential for learning. They also promote a safe environment for the wider community.
Early Learning Victoria staff must model the behaviour expected of families and the community. This includes in face-to-face and online interactions.
3.1 Responsibilities of families
Families play an important role in ensuring that communication remains positive, respectful and courteous. See the Code of conduct for families.
Families are responsible for informing their child’s educators if their child’s routine or needs have changed. See the Family handbook for more information.
We also encourage families to read the Handling complaints and feedback policy. If they have concerns, the details of the people to contact are displayed clearly in the foyers of Early Learning Victoria centres.
3.2 Responsibilities of staff
Breaches of this Code of Conduct
If you think this Code of conduct has been breached, report the problem to your centre’s nominated supervisor (centre director).
If the breach involves your nominated supervisor, report it to your area manager.
The nominate supervisor and/or area manager must refer all matters to the Department’s Conduct and Integrity Division. This is in line with the Guidelines for managing conduct and unsatisfactory performance in Early Learning Victoria centres.

Definitions
Complaint: In the context of this policy, a complaint is any expression of dissatisfaction made to or about Early Learning Victoria. This could be related to services, staff or the handling of a complaint, where a response or resolution is required.
Regulatory Authority: The Regulatory Authority is established by the National Law. It regulates providers of early childhood education and care services to ensure they protect children’s safety, health and wellbeing. It also ensures compliance with the Child Safe Standards.
From 1 January 2026, the Regulatory Authority for early childhood services in Victoria is the Victorian Early Childhood Regulatory Authority (VECRA) under regulatory schemes outlined on its website. VECRA is also the integrated sector regulator of the Child Safe Standards for all early childhood services in Victoria.

It was approved by the CEO, Early Learning Victoria, Department of Education on 20 March 2026.
Early Learning Victoria regularly reviews its policies and procedures. This policy is due for review on 20 March 2027 unless changes in legislation or Department of Education policy require it to be reviewed sooner.
